OPTIMUMFOODIE TERMS OF SERVICE

By enrolling in any OptimumFoodie program, coaching package, meal plan, consultation, challenge, masterclass, or related service, you acknowledge that you have read, understood, and agreed to the following Terms of Service.

1. NATURE OF OUR SERVICES

OptimumFoodie provides nutrition coaching, personalised meal plans, accountability support, educational resources, wellness guidance, and behaviour-change coaching.

Our services are educational and coaching-based and are not intended to diagnose, treat, cure, or prevent any medical condition.

Clients should continue to follow the advice of their healthcare providers and seek medical attention where appropriate.

2. RESULTS DISCLAIMER

Every client is different.

While many clients achieve significant weight loss, health improvements, and body-composition changes, OptimumFoodie does not guarantee any specific outcome.

Client results depend on multiple factors, including consistency, adherence to recommendations, lifestyle habits, medical conditions, medications, stress levels, sleep quality, and physical activity.

3. CLIENT RESPONSIBILITIES

To receive the full benefit of the program, clients agree to:

• Complete onboarding forms honestly and accurately.

• Attend scheduled coaching sessions.

• Communicate changes in circumstances that may affect participation.

• Follow agreed communication channels.

• Implement recommendations to the best of their ability.

• Raise concerns promptly so they can be addressed during the coaching process.

Failure to participate in the coaching process does not constitute failure of service delivery by OptimumFoodie.

4. REFUND, CREDIT AND CANCELLATION POLICY

Because OptimumFoodie programs involve personalised coaching, planning, administration, and capacity allocation, refunds are handled according to the stage of service delivery.

4.1 Before Onboarding Begins

Clients may request a full refund within twenty-four (24) hours of payment, provided that:

• No onboarding form has been completed.

• No consultation has been conducted.

• No program work has commenced.

Approved refunds will be processed within a reasonable timeframe.

4.2 After Onboarding Has Commenced

Once a client has completed the onboarding process, refunds are generally not available.

At this stage, OptimumFoodie has already begun service delivery through client assessment, program preparation, administrative processing, and allocation of coaching resources.

Where a client experiences an unexpected emergency after onboarding but before program delivery is completed, OptimumFoodie may, at its sole discretion, offer:

• A deferred start date; or

• A program credit valid for future use.

4.3 After Meal Plan Development Has Begun

Once meal-plan development, consultation review, program design, or coaching preparation has commenced, payments become non-refundable.

4.4 After Meal Plan Delivery or Coaching Commencement

Once any of the following have occurred:

• A meal plan has been delivered;

• A consultation has been conducted;

• Coaching sessions have commenced;

• Program resources have been provided;

• Dedicated coaching time has been reserved;

all payments become non-refundable.

5. PROGRAM CREDITS

Where OptimumFoodie elects to provide a program credit in place of a refund:

• The credit must be used within ninety (90) days.

• Credits are non-transferable.

• Credits cannot be exchanged for cash.

• Credits may only be applied to OptimumFoodie services.

6. CIRCUMSTANCES THAT DO NOT QUALIFY FOR REFUNDS

Refunds will not be issued because:

• The client changes their mind.

• The client becomes too busy.

• The client no longer wishes to participate.

• The client fails to attend appointments.

• The client fails to communicate availability.

• The client does not follow recommendations.

• The client experiences slower-than-expected progress.

• The client pauses participation for an extended period.

• The client chooses not to continue with the program after services have commenced.

7. EXCEPTIONAL CIRCUMSTANCES

OptimumFoodie reserves the right to make exceptions on a case-by-case basis where circumstances warrant additional flexibility.

Such accommodations may include:

• Program pauses

• Program extensions

• Session credits

• Deferred start dates

• Alternative coaching arrangements

The provision of such accommodations does not create an entitlement to a refund.en created.

• Revised meal plans have been prepared.

• Coaching sessions have been scheduled.

• Coaching resources have been provided.

• Dedicated coaching time has been reserved.

8. PROGRAM DELIVERY

Program deliverables may include:

• Personalised meal plans

• Nutrition coaching sessions

• Progress reviews

• Accountability check-ins

• Educational resources

• Recipe recommendations

• Lifestyle coaching

• Group support (where applicable)

Deliverables vary depending on the package purchased.

9. MEAL PLAN DEVELOPMENT

Personalised meal plans are developed using information provided by the client during onboarding and consultations.

The creation and delivery of a personalised meal plan constitutes partial fulfilment of the purchased service.

Meal plans may be revised during the coaching process based on:

• Progress

• Feedback

• Lifestyle changes

• Medical considerations

• Adherence challenges

Further modifications typically occur during scheduled coaching consultations.

10. APPOINTMENT POLICY

Coaching sessions are scheduled based on mutually agreed-upon times.

Appointment times are selected in consultation with the client, and calendar invitations are sent accordingly.

Clients are responsible for attending appointments at the agreed time.

If a scheduled time is no longer suitable, clients are expected to notify OptimumFoodie as early as possible so alternative arrangements can be considered.

11. RESCHEDULING POLICY

Clients may request to reschedule appointments.

Whenever possible, at least 24 hours’ notice should be provided.

While OptimumFoodie will make reasonable efforts to accommodate schedule changes, alternative appointment times are subject to availability.

Repeated last-minute cancellations or rescheduling requests may limit available options.

12. MISSED APPOINTMENTS AND NO-SHOWS

A missed appointment occurs when:

• A client does not attend a scheduled session.

• A client arrives significantly late.

• A client fails to communicate inability to attend.

Repeated missed appointments may result in:

• Forfeiture of sessions.

• Removal from the coaching schedule.

• Closure of the coaching engagement.

No refunds will be issued for missed appointments.

13. EXECUTIVE COACHING PROGRAMS

Executive Coaching Programs involve a high-touch level of support and limited coaching capacity.

Dedicated time is reserved specifically for each Executive Coaching client.

When an Executive Coaching client books a coaching slot, that time is reserved exclusively for them and cannot typically be allocated to another client at short notice.

For this reason, missed appointments, repeated cancellations, or prolonged non-participation may result in forfeited coaching opportunities without refund.

14. PROGRAM PAUSES

Clients may request a temporary pause due to:

• Illness

• Medical treatment

• Pregnancy-related complications

• Family emergencies

• Significant life events

• Travel

All pauses must be approved by OptimumFoodie.

15. MAXIMUM PAUSE PERIOD

Approved pauses may last for a maximum of ninety (90) days.

Clients who do not resume participation within 90 days may be required to:

• Re-enroll in a new program;

• Pay a reactivation fee; or

• Undergo a new onboarding process before services resume.

Programs cannot remain indefinitely suspended.

16. RETURNING AFTER A PAUSE

16.1 Where a client returns following an approved pause, OptimumFoodie may provide reasonable accommodations, including:

• Updated consultations

• Schedule reviews

• Program adjustments

Such accommodations are provided as a goodwill measure and do not create a new program term.

The original program purchased remains the governing service agreement.

16.2 Where a client’s circumstances have changed significantly during a pause period, including but not limited to pregnancy, postpartum recovery, major weight changes, medical diagnoses, surgery, medication changes, or extended periods of inactivity, OptimumFoodie may require a reactivation fee before services resume, to cover a new assessment, meal-plan redesign, or program update. 

The applicable fee and requirements will depend on the level of work required to safely and appropriately update the client’s program.

OptimumFoodie reserves the right to determine whether the client’s existing program remains suitable or whether modifications are required before coaching can continue.

17. CLIENT CONCERNS

Clients are encouraged to raise concerns as soon as they arise.

OptimumFoodie cannot reasonably address concerns, troubleshoot challenges, or make program adjustments when concerns are not communicated during active participation in the coaching process.

18. TERMINATION OF SERVICES

OptimumFoodie reserves the right to discontinue services where a client:

• Repeatedly misses appointments.

• Is abusive or disrespectful toward staff.

• Refuses to follow program procedures.

• Creates unreasonable disruption to service delivery.

Where services are terminated under these circumstances, no refund shall be due.

19. ACCEPTANCE OF TERMS

By making payment and enrolling in any OptimumFoodie service, the client confirms that they have read, understood, and agreed to these Terms of Service.
